Listed Offenses and Individual Reporting Requirements of Convictions

Listed Offenses under the Sex Offenders Registration Act

A conviction of any of the following will result in immediate dismissal for school employees/ contractors.

  • Accosting, enticing, or soliciting a child for immoral purpose

  • Involvement in child sexually abusive activity or material

  • A third or subsequent violation of any combination of engaging in obscene or indecent conduct in public, indecent exposure, or a local ordinance substantially corresponding to either offense

  • First, second, third or fourth degree Criminal Sexual Conduct (CSC)

  • Assault with intent to commit Criminal Sexual Conduct

  • If the victim is less than 18 years of age, the crime of gross indecency (except for a juvenile disposition or adjudication), kidnapping, sodomy, or soliciting another for prostitution

  • Leading, enticing, or carrying away a child under 14 years of age.

  • Pandering

  • Any other violation of a state law or local ordinance constituting a sexual offense against an individual less than 18 years of age

  • An offense committed by a sexually delinquent person

  • An attempt or conspiracy to commit one of the offenses listed above

  • Any offense under the laws of the United States, any other state, or any other country or tribal or military law, that is substantially similar to a listed offense

    Criminal Charges that Must be Reported by School Applicants/Employees/Contractors

    If you are charged with any of the following, you must report it to the Assistant Superintendent of Human Resources and the Michigan Department of Education within 3 business days after being arraigned.

    Failure to do so is a crime.

  • Any felony

  • Any of the following misdemeanors:

    • Criminal sexual conduct in the 4th degree, or attempt to commit

    • Child abuse in the 3rd or 4th degree, or an attempt to commit

    • Misdemeanor involving cruelty, torture, or indecent exposure involving a child.

    • A misdemeanor violation of the following (Public Health Code):

      • MCL 333.7410: Distribution of marihuana by 18 year old or older

    • Violations of the following (Michigan Penal Code):

      • MCL 750.115: Breaking and entering or entering without breaking; buildings, tents, boats, railroad cars; entering public buildings when expressly denied

      • MCL 750.141a: Allowing a minor to consume or possess an alcoholic beverage or a controlled substance

      • MCL 750.145a: Accosting, enticing or soliciting a child for immoral purpose

      • MCL 750.335a: Indecent exposure

      • MCL 750.359: Larceny from a vacant dwelling

    • Violations of the following misdemeanors (Michigan Penal Code):

      • MCL 750.81: Assault and battery

      • MCL 750.81a: Assault; infliction of serious or aggravated injury

      • MCL 750.145d: Use of the Internet or computer system to commit crimes

    • Misdemeanor violation of (Michigan Liquor Control Code):

      • MCL 436.170: Selling or furnishing alcoholic liquor to person less than 21 years of age; failure to make diligent inquiry

    • Any misdemeanor violation of:

      • MCL 28.722: “Listed Offenses” (Sex Offender List)

    • A violation of a substantially similar law of another state, political subdivision of this state or another state, or of the United States.

      Criminal Convictions that Must be Reported by School Applicants/Employees/Contractors

      If you are convicted after having been initially charged with any of the following crimes, you must report it immediately to the Assistant Superintendent of Human Resources and the Michigan Department of Education.

      Failure to do so is a crime.

  • CSC in any degree, assault with intent to commit, attempt or conspiracy to commit.

  • Felonious assault on a child, child abuse in the 1st degree, attempt to commit

  • Cruelty, torture, or indecent exposure involving a child

  • Violations of the following (Public Health Code):

    • MCL 333.7401: Manufacturing, creating, delivering, or possessing with intent to manufacture, create, or deliver controlled substance, prescription form, or counterfeit prescription form, dispensing, prescribing, or administering a controlled substance

    • MCL 333.7403: Knowingly or intentionally possessing a controlled substance, controlled substance analogue, or prescription form

    • MCL 333.7416: Recruiting, inducing, soliciting, or coercing a minor to commit a felony

  • Violations of the following (Michigan Penal Code):

    • MCL 750.83: Assault with intent to commit murder

    • MCL 750.89: Assault with intent to rob and steal

    • MCL 750.91: Attempt to murder

    • MCL 750.145a: Accosting, enticing or soliciting a child for immoral purpose

    • MCL 750.145b: Accosting, enticing or soliciting a child for immoral purpose; prior conviction

    • MCL 750.145c: Child pornography

    • MCL 750.316: First degree murder

    • MCL 750.317: Second degree murder

    • MCL 750.350: Leading, taking, carrying away, decoying, or enticing away child under 14

    • MCL 750.448: Soliciting, accosting, or inviting to commit prostitution or immoral act

    • MCL 750.455: Pandering

    • MCL 750.529: Use or possession of dangerous weapon; aggravated assault

  • Felony Conviction of:

    • MCL 750.145d: Use of internet or computer system to commit crimes, attempt or conspiracy to commit

  • Violation, if victim is less than 18 of:

    • MCL 750.158: Crime against nature or sodomy; attempt or conspiracy to commit

    • MCL 750.349: Kidnapping; attempt or conspiracy to commit

  • Except for a juvenile disposition or adjudication, a violation, if victim is less than 18 of:

    • MCL 750.338: Gross indecency; between male persons; attempt or conspiracy to commit

    • MCL 750.338a: Gross indecency; female persons; attempt or conspiracy to commit.

    • MCL 750.338b: Gross indecency; between male and female persons; attempt or conspiracy to commit

  • An offense committed by a person who was, at the time of the offense:

    • MCL 750.10a: Sexually delinquent persons; attempt or conspiracy to commit

  • A violation of a substantially similar law of another state, political subdivision of this state or another state, or of the United States
